Cultre Agency: Terms of Service

These Terms of Service (“Terms”) govern your use of Cultre Agency's platform and services. By signing up as a member or using our services, you agree to be bound by these Terms. Please read them carefully.

1. Definitions
Agency: Cultre Agency, a non-exclusive talent modeling and acting agency based in Milwaukee, Wisconsin.

Talent: Individuals (models, actors, etc.) who register with Cultre Agency to offer their services for advertising, digital marketing, photography, and video.

Businesses: Companies and organizations using Cultre Agency’s platform to hire talent for advertising, digital marketing, social media, and related projects.

Membership: The subscription plan that gives Talent and Businesses access to Cultre Agency’s platform and services.

Bookings: Agreements between Talent and Businesses for specific projects, facilitated through Cultre Agency’s platform.

2. Services Overview
Cultre Agency provides a digital platform that connects local Milwaukee businesses with local Talent for advertising, marketing, and creative media projects. We offer the following:

A searchable database of Talent and Businesses.

A platform for Talent and Businesses to communicate and establish working relationships.

Set rates for Businesses to hire Talent, ensuring clarity and fairness in all bookings.

3. Non-Exclusive Agreement

Cultre Agency operates on a non-exclusive basis. Talent are free to pursue work outside of Cultre Agency without restrictions. Similarly, Businesses may engage other agencies or talent outside of Cultre Agency.

4. Membership

Talent Membership: Talent must register as members of the platform to be visible to Businesses and eligible for bookings.

Business Membership:

Businesses must register to access the Talent database and talent contact information.

Membership fees are set annually. All members agree to maintain accurate and up-to-date profiles and company information.

5. Talent Bookings and Rates

Cultre Agency facilitates communication and bookings between Talent and Businesses.

All bookings made through the platform are subject to pre-set rates established by Cultre Agency.

Rates include hourly or project-based fees, which are visible to both Talent and Businesses before booking.

Once a booking is agreed upon, both parties must comply with the terms, including payment schedules and deliverables.

Any additional services, changes in scope, or extended hours must be communicated and agreed upon in writing before execution.

6. Payments and Fees

All payments for bookings must be processed through the Cultre Agency platform.

Talent will be paid according to the pre-set rates established at the time of the booking.

Payments to Talent will be released after the successful completion of a project, and after Business approval, within 5 business days.

7. Cancellations and Refunds

For Talent: Talent may cancel a booking up to [insert hours/days] before the scheduled start time without penalty. Cancellations after this period may result in a cancellation fee.

For Businesses: Businesses may cancel bookings up to 4 says before the project without incurring penalties. If a cancellation is made after this period, the Business may be charged up to 50% of the agreed booking fee with the Talent.

Refund requests will be assessed on a case-by-case basis by Cultre Agency.

8. Responsibilities and Conduct

For Talent: Talent are expected to maintain professionalism, punctuality, and quality of work throughout their engagement. Failure to meet project deliverables or adhere to agreed schedules may result in account suspension or removal.

For Businesses: Businesses must ensure clarity in their project descriptions and expectations, and provide a safe and respectful environment for Talent during photo or video shoots.

9. Intellectual Property

For Talent: By participating in a booking, Talent grants Businesses and Cultre Agency a non-exclusive, royalty-free right to use their likeness, images, and performances as agreed upon in the booking contract for promotional and advertising purposes.

For Businesses: Businesses retain the right to use any photos, videos, or content produced during a booking as described in the booking agreement.

10. Disputes

Cultre Agency is not responsible for disputes arising between Talent and Businesses. However, we may facilitate resolution if possible. Both parties are encouraged to maintain clear communication throughout the project. Please read our Safety and Transparency Guidelines

Any unresolved disputes will be governed by the laws of the State of Wisconsin, and any legal action must be filed in the courts located in Milwaukee, Wisconsin.

11. Termination

Cultre Agency reserves the right to terminate or suspend accounts for Talent or Businesses at any time for violations of these Terms or misuse of the platform.

12. Changes to the Terms

Cultre Agency may update these Terms from time to time. You will be notified of any material changes, and continued use of the platform constitutes acceptance of the new Terms.
